It is essential that any Performance Counselling & Discipline Policy remains current, is well understood and adhered to at all times.   Performance counselling & discipline processes need to be consistent, legally defensible and avoid procedural and substantive unfairness.  This will protect your company from incurring significant time and financial burdens when, for example, responding to a claim of unfair dismissal and in the payment of penalties ordered by the Fair Work Commission.
